European Consumer Centre (ECC) provides you with
free information and advice on your consumer rights
in the EU.
Legislative
protection
Consumers are protected under the Sale of Goods
and Supply of Services Act 1980. This states that
a service provider must have the necessary skill
to provide a service, the materials used must
be sound and the service should be provided with
due care and diligence. If the job is not carried
out with the above criteria then you may be entitled
to repair, replacement or a refund.
What
do I do if something goes wrong?
- Complain
to the service provider.
- Know
what you are entitled to and ask for it.
- If
the service provider does not resolve the issue
write a letter of complaint. Keep a copy of
the letter and send it by registered mail.
- Attach
all supporting documentation including the written
quotation, sales brochure and plans/drawings
etc.
- Keep
a record of any phone conversations, letters
etc.
- Get
an independent expert to survey the work if
necessary.
- Make
a complaint to the relevant trade/professional
association.
If
the service provider does not remedy the situation
for you then you may take a claim against the
service provider in the Small Claims Court. While
this will only cost you €7.62 it
only covers small home improvement jobs up to
the value of €1,270. Contact
a solicitor where larger sums of money are involved.
Be wary of employing contractors in an "unofficial
capacity" as you may not have any comeback
if things go wrong. If someone comes to your door
offering a service make sure you get their full
details. Having somebody's mobile number is not
enough. There is no legal protection for you if
you enter into a contract with a company that
is not legitimate or if you buy a service from
somebody who is not acting in the course of a
business.
Tips
Before getting work done on your house the ECC
advises the following:
- Be
clear about the job you require from the start.
- Shop
around for a couple of quotations from a reputable
or recommended company.
- Check
if the company is a member of the National Guild
of Craftsman or another recognised trade association.
